Terms of service

These Terms of Service (“Terms”) govern access to Support Master websites, trials, and software services operated by Support Master (“Support Master”, “we”, “us”). If you enter a separate order form, statement of work, or enterprise agreement (“Order Form”), that document controls where it conflicts with these Terms on commercial topics (fees, term, SLA). Our Privacy Policy explains how we handle personal information.

1. Acceptance

By creating an account, accessing a trial, or using the service on behalf of an organization, you represent that you have authority to bind that organization and agree to these Terms. If you do not agree, do not use the service.

2. The service

Support Master provides cloud software for commerce operations (including modules such as order and inventory management, retail, food, growth, AI-assisted workflows, and related integrations). Features available to you depend on your plan, Order Form, and configuration. We may modify or discontinue non-material aspects of the service with reasonable notice; material adverse changes may require agreement under your Order Form.

3. Accounts and access

You are responsible for accurate registration information, safeguarding credentials, and all activity under your accounts. You must configure roles and permissions appropriate to your organization. We may suspend access if we reasonably believe there is a security risk, violation of these Terms, or non-payment where applicable.

4. Customer data

“Customer Data” means data you or your users submit or transmit through the service (including operational commerce data). You retain ownership of Customer Data. You grant us a limited license to host, process, and display Customer Data solely to provide and improve the service, secure it, and comply with law. Processing details may be further described in our data protection overview and any Data Processing Agreement (DPA) with your organization.

You represent that you have necessary rights to provide Customer Data and that its processing under these Terms does not violate third-party rights or applicable law.

5. Acceptable use

You agree not to:

  • use the service in violation of law or third-party rights;
  • probe, scan, or test vulnerabilities without our prior written consent;
  • interfere with or disrupt the service or other customers’ use;
  • introduce malware, excessive automated load, or unauthorized data extraction beyond API limits;
  • misrepresent identity, send unlawful or harmful content through integrations, or use the service to build a competing product by scraping or reverse engineering our UI except as permitted by law;
  • use the service to process highly regulated data types not expressly agreed in writing (for example certain health or biometric categories) without appropriate compliance measures.

6. Fees and payment

Paid plans are billed as set forth in your Order Form or checkout flow. Taxes may apply. Late payment may incur suspension after notice where permitted. Refund practices, if any, are described in our refund policy or your Order Form.

7. Confidentiality

Each party may receive non-public information from the other (“Confidential Information”). The recipient will use reasonable care to protect it and use it only for the purpose of the relationship. Exceptions include information that is public, independently developed, or rightfully received from a third party.

8. Intellectual property

We and our licensors own the service, software, documentation, and our branding. Except for the limited rights to use the service under these Terms, no rights are granted. Feedback you provide may be used by us without obligation to you.

9. Third-party services

Integrations and third-party products you connect are governed by their own terms. We are not responsible for third-party services or for data once exported outside Support Master at your direction.

10. Warranties disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF NO FEES APPLIED, ONE HUNDRED DOLLARS (USD $100)).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law. Specific caps or exclusions may be superseded by an Order Form where stated.

12. Indemnity

You will defend and indemnify us against third-party claims arising from Customer Data, your use of the service in violation of these Terms, or your violation of law—provided we promptly notify you and cooperate reasonably.

13. Term and termination

These Terms remain in effect while you use the service. Paid subscriptions continue for the term in your Order Form and renew as stated there. We may suspend or terminate for material breach after notice where reasonable. Upon termination, your right to access ceases; export and data handling follow your Order Form or DPA. Provisions that by nature should survive (liability, confidentiality, governing law) will survive.

14. Governing law and disputes

Unless your Order Form specifies otherwise, these Terms are governed by the laws of India, excluding conflict-of-law rules. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, subject to mandatory consumer protections where applicable.

Note: Replace jurisdiction and venue with your counsel’s choice for production contracts.

15. General

These Terms constitute the entire agreement regarding the service (together with the Privacy Policy and Order Form). If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign in connection with a merger or sale.
